A New Landscape for Data Governance in Indonesia

The Faculty of Law, Universitas Palangka Raya, organised an interesting international seminar today with the theme: “Legal Reform in the Era of AI and Global Complexity”. This is timely. As we are all globally transforming into a digital society, social changes take place and require responses from legal scholars and lawmakers.

In this event, I spoke about the trend of digitalisation and datafication which further led us to automatisation. The processes had certainly brought about new tensions such as IPR disputes and privacy violations. I also highlighted how the data protection issue has now escalated to global trade and geopolitical tensions. At the second half of the presentation, I shared about the new law in Indonesia that introduces a new norm in data governance, ie Undang-Undang No. 27 Tahun 2022 tentang Pelindungan Data Pribadi (Law. No. 27/2022 on Personal Data Protection).

Rights of Data Subject

I noted that under this UU no. 27/2022, data users/controllers must ensure the right of data subjects to obtain information, to ensure data accuracy, to access his/her own data, to delete data, to withdraw consent, to deal with data automatisation, to move data and obtain compensation.
